1. User Notice:
By purchasing the Elaine Biss Type font license you only receive a limited time access for using the font. In no way should you assume that you possess complete or partial copyright to this font. If you are purchasing any Elaine Biss Type fonts or any other font distributed by the Elaine Biss Type group (the International House of Fonts, Sherwood Collection, and others) by downloading or though emails constitute the same agreement without any chances. The agreement exists between the end user and the Elaine Biss Type Type foundry Inc. You assure us that all the terms and conditions of the software will be followed. If you have purchased the Elaine Biss Type font in hard copy format such as CD-ROM or floppy disk then removing the media disk from its protective cover signifies the same agreement of use.
However, if you disagree with the terms and conditions then you need to return the hard copy package without opening it to the same place from where the package was purchased. If the Elaine Biss Type font was downloaded or sent through email, then all files must be erased. The end user might be required to present a signed affidavit to receive a refund on purchase amount. 2. License Grant:
The Elaine Biss Type purchased license software is for use only on a total of 5 devices, one site, and one single platform. The device means computer, character generator, printer, server or any other machine using front data to resize letters. Site is one physical location and the platform means computer operating system such of ‘Windows’ or ‘Macintosh’.
A laptop can be considered as one such device. Working offsite is permissible according to the basic license and considered an extension of the ‘site’. If the end user wishes to transfer the work from one network to another then the end user needs additional license.
If the Elaine Biss Type fonts are installed on more than 5 devises or a LAN/WAN server with more than 4 devises or willing to give other users access to the fonts from any other location or if the printer / service bureau installs the fonts for more than one time use (Service Bureau) then additional licensing is essential. In relation to the Service Bureau clause, the font software must be deleted once the work is completed or buy own license.

For unhindered access to the Elaine Biss Type software, the end user can make a copy of the software for backup. If you wish to transfer the original software to any third party then that person should agree to the terms and conditions clearly. 3. Fair Use:
Importance should be given to fair use of the Elaine Biss Type software. By purchasing the software, the end user (you!) agrees to using the Elaine Biss Type font only for personal use for self promotion though business cards, brochures and newsletters; personal correspondence and document writing. Wishing to use the Elaine Biss Type font software for commercial or professional use means additional license.
Professional or commercial use is defined through but not limited to freelance designers, corporate advertising firms, and small design firms incorporating the Elaine Biss Type font for client designing projects or self promotion activities. Without any additional licensing, most of the alphanumeric fonts are allowed provided the user follows the Grant of License requirement.
An additional one – time license is due if the end user wishes to use illustrative elements, popularly known as ‘dingbats’, ‘extras’ and ‘ornaments’ for logo designing. If you desire to use the Elaine Biss Type license for any large scale campaign such as advertising, product packaging, promotion for entertainment activities, corporate identity designing, store signage or any such thing that require multimedia intervention such as internet, television or print media then you might require an additional license. This clause applies also to client based work or in-house work.

When the Elaine Biss Type license is used for a product intended as profit making venture then a royalty based Commercial license is required. This entails products such as rubberstamps, wrist watches, refrigerator magnets, decals, stencil kits, house numbers, digital art, and other computer applications on which the Elaine Biss Type font is used as the main design element. The end user can modify the font software only for in-house and non-commercial use and in no way/format should the end user modified Elaine Biss Type font software be sold or distributed. Back to the top
4. Embedding of Fonts:
If the document created using Elaine Biss Type font is set to “Print and Preview” mode, only then can the fonts be embedded. Otherwise, if the document entails extraction, edition, and transference of the work in any way with the embedding intact then an additional license is a pre-requisite. Back to the top
5. Copyright:
The end user does not have the permission to distribute the software in full or in part to any buyer or user without written consent of the Elaine Biss Type. The Elaine Biss Type font is licensed under law and has intellectual property information of sensitive nature. Back to the top
6. Disclaimer and Limited Warranty:
Elaine Biss Type provides the warranty that the software is devoid of any errors. However, in case of defective media then the software will be replaced within 90 days of purchase. Elaine Biss Type will not take any responsibility for replacing the software if faults happen due to end user’s neglect, abuse or accident.
Note that the Elaine Biss Type font software and any accompanying written material do not offer warranty of any kind, either implied or expressed. The Elaine Biss Type disclaims any warranty of fitness for any specific purpose. Moreover, the Elaine Biss Type does not claim any results amounting from the use of the software or from any of the accompanied written material in terms of – reliability, correctness, accuracy, or current use. 7. Update Policy:
Registered users of Elaine Biss Type will be offered updated versions of existing software as and when they are available. Back to the top
8. Purchaser’s Indemnity:
The end user has the responsibility of informing any person such as employees or employers having access to the Elaine Biss Type software about the terms and conditions of the Standard License Agreement for full abidance. If any breach in this agreement occurs then you as the end user agree to indemnify the Elaine Biss Type of any claims, attorney’s fees, and liabilities arising out of the dispute. If this clause is not adhered to then the Elaine Biss Type has the right to revoke the Grant Of License anytime they want. Back to the top
9. Construction:
The laws and regulations mentioned in this agreement and any other constructed in Elaine Biss Type is in accordance with the Pennsylvania state laws. Therefore, any dispute arising between the end user and the Elaine Biss Type shall be resolved within the jurisdiction of Lancaster County, Pennsylvania.
Purchase of Elaine Biss Type fonts directly from Elaine Biss Type means that the end user is already registered. If the Elaine Biss Type font was purchased from any reseller, then the end user is requested to keep a record of the billings, time of the purchase and place of the purchase. If the Elaine Biss Type font was purchased in the form of CS then register with Elaine Biss Type through the registration card enclosed with every package. Back to the top
